Karnataka HC notice to MUDA and Mysuru DC

The High Court of Karnataka on Friday ordered issue of notice to Mysore Urban Development Authority (MUDA) and the Deputy Commissioner of Mysuru on a petition questioning the rejection of an application to use the Bal Bhavan, situated at Bannimantap, on rent for organising Tipu Jayanti celebrations on Sunday.

Justice S. Sunil Dutt Yadav passed the order on a petition filed by Tanveer Sait, former Minister. It was contended that the petitioner had submitted a plea to MUDA to hold the event, but the authority had rejected it even though there was no bar on celebrating Tipu Jayanti by private organisations and individuals. The petitioner stated that a Division Bench of the HC had directed that “the government must give permission and take precautions to ensure such functions are held in a peaceful and harmonious manner”.

According to the petitioner, MUDA had rejected the application stating that “permission from the government is being awaited”. Meanwhile, the counsel for MUDA said that a copy of the interim order passed by the Division Bench on Tipu Jayanti was not available and a further decision could be taken as Saturday and Sunday were public holidays.

As the counsel for the petitioner said the petitioner would not insist on November 10 and would accept getting Bal Bhavan on rent any day next week to hold the Tipu Janti event, the Bench ordered issue of notice and adjourned the case to November 13.
