Big news in the DePuy Hip Impant litigation:

(Birmingham, AL)  Johnson & Johnson has agreed to pay more than $2.5 billion to resolve lawsuits involving its DePuy hip implants recalled in 2010, according to documents presented at a court hearing in the U.S. District Court for the Northern District of Ohio on November 19, 2013. The metal on metal DePuy hip implants were recalled after high failure rates were reported.  Some 8,000 hip implant patients who underwent revision surgery are included in the settlement announced in court documents.

“We are happy our clients are getting financial relief, though no amount of money could fully compensate them for the pain they have suffered or restore the quality of life they previously enjoyed,” said attorney Annesley H. DeGaris of Cory Watson Crowder & DeGaris. Attorneys with Cory Watson Crowder & DeGaris represent several hundred hip implant patients and DeGaris has served on the Plaintiffs’ Steering Committee in the multidistrict litigation.  The settlement is believed to be the largest such medical device litigation settlement in U.S. history.  DePuy Orthopaedics, Inc., a division of Johnson & Johnson, recalled the ASR™ Hip Resurfacing System and the ASR™ XL Acetabular System because of high failure rates that necessitated revision surgeries, according to the recall notice published by the Food and Drug Administration.

Cory Watson Crowder & DeGaris attorneys have been appointed to numerous leadership positions in litigation involving the failure of orthopaedic devices and have represented clients in cases involving knee replacements, hip replacements, orthopedic screws and other medical devices.  Cory Watson shareholder Annesley H. DeGaris serves on the Plaintiffs’ Leadership Counsel Committee in multidistrict litigation involving Stryker hip devices. On July 6, 2012, the FDA announced Stryker’s recall of the Rejuvenate and ABGII hip devices and terminated distribution of the devices given the potential risks associated with “fretting and corrosion of the modular neck junction.”
