Those dollars will buy a whole lot of doughnuts.
The Krispy Kreme-loving Florida man police arrested when they confused dried doughnut glaze in his car for crystal meth is suing the city of Orlando and the maker of the drug test that supposedly verified the sweet stuff was an illegal drug.
Daniel Rushing is seeking $15,000 — or about 15,151 99-cent glazed Krispy Kremes — in damages for his December arrest, the Orlando Sentinel reported.
In his suit filed in Florida last week, Rushing claimed Cpl. Shelby Riggs-Hopkins, an eight-year force veteran, should have known the difference between crystal meth and sugary glaze. After all, the sweet-toothed snacker even told her about his Krispy Kreme habit.
“I said, ‘It’s icing from a doughnut!'” he told the Orlando Sentinel while recalling the 2015 traffic stop.
Riggs-Hopkins pulled Rushing over last year when he failed to come to a full stop before he pulled out of a 7-Eleven parking lot. He gave permission to search his car, hoping he’d get out of a ticket for readily complying with her request.
Riggs-Hopkins found “a rock like substance on the floor,” she wrote in a report. Rushing told her it was just crumbs from his twice-monthly visits to the doughnut shop.
“Every other Wednesday, I get a glazed doughnut from Krispy Kreme,” he told the local newspaper. “(Police) found four little pieces of icing on the floorboard, which I’m kind of embarrassed about because I should have, you know, vacuumed the car better.”
But a roadside drug testing kit made by Safariland showed the white flakes was some kind of methamphetamine.
Rushing was arrested on drug charges, but weeks later, when a state crime lab showed the substances was just icing, the charges against him were dropped.
