MERRITT ISLAND, Fla. (WESH) – A Florida man is facing charges after killing another man as he was acting out lyrics to a rap song.

According to the Brevard County Sheriff’s Office, 22-year-old Rodney Patrick was acting out the lyrics of a Waka Flocka Flame song “Bustin At ‘Em.”

The song features lyrics like “shoot first, ask questions last.”

Authorities say Patrick picked up a gun he thought was unloaded and fired it, killing 17-year-old Douglas Winslow.

Patrick initially told the 911 dispatcher that Winslow asked to see the gun and accidentally shot himself.

“I handed my little brother my gun, and I didn’t know it was loaded, and he shot himself in the head,” Patrick told 911 dispatchers.  “It was a Colt, it was my 45. He just wanted to see it, he thought it was so cool. I thought I had cleared it and everything. ”

However, deputies say Patrick is the one who pulled the trigger.

“We’ve got a gun being waved around. We’ve got the safety being clicked on and off, a loaded gun. A reasonable person knows or should know that action can result in somebody’s death,” said Gary Beatty, Brevard County prosecutor.

Patrick is being charged with tampering with evidence and possession of a controlled substance.

He faces 25 years to life in prison if convicted.
