Pemberton to be arraigned Friday for Laude killing


(Updated 2:51 p.m.) Lance Corporal Joseph Scott Pemberton, the suspect in the killing of Filipina transgender Jeffrey "Jennifer" Laude, will be arraigned Friday at the Olongapo City Regional Trial Court Branch 74.

Pemberton, a US Marine, was brought inside the Olongapo Hall of Justice early Friday.
 
Pemberton was already inside the Hall of Justice before 7 a.m., according to a tweet by GMA's Unang Hirit.

 
A report by dzBB's Cecilia Villarosa said he is to undergo booking procedures.

 
These include having his fingerprints and mugshots taken.

Murder raps were filed against Pemberton on Dec. 15 for the killing of Laude after the Olongapo City Prosecutor's Office found probable cause to do so.
 
Security was tight around the Olongapo City regional trial court where Pemberton is expected to be arraigned on Friday, GMA News' Ian Cruz reported.
 
An added safety force was deployed around the Hall of Justice to thwart any attempt by protesters to get inside, radio dzBB's Divine Reyes reported .

Shortly after the convoy left, a report said the lights at the JUSMAG facility where Pemberton was detained were switched off around 2:40 a.m.
 
A white sport-utility vehicle with diplomatic plates then arrived at the Olongapo City Hall of Justice shortly after 4 a.m. Friday.
 
The van was allowed to enter the tightly secured compound, and the gates were immediately closed, radio dzBB's Manny Vargas reported.

Lt. Col. Harold Cabunoc, chief of the Armed Forces of the Philippines Public Affairs Office, confirmed Pemberton was transported by US personnel to Olongapo City early Friday.

"The convoy of vehicles left Camp Aguinaldo at 2 a.m. and arrived Olongapo City at 4:30 a.m.," he said.

"The PNP and MP Battalion provided security augmentation during the travel," Cabunoc added.
 
On Thursday, representatives from the US Naval Forces led by Commander Timothy Stone inspected the Olongapo RTC courtroom where Pemberton is to be presented for arraignment.
 
A representative from the US Naval Criminal Investigative Service also arrived Thursday afternoon but declined to give a statement.
 
Olongapo City police had adopted security measures at the courtroom.

Pemberton is still under the custody of the US government after the Philippines' request for his custody was turned down.
 
For its part, the US issued a statement saying it will cooperate with the Philippine government to make sure justice prevails.

Laude was found dead in a lodge in Olongapo City on the night of October 11, after checking into the establishment with a foreign companion who has been identified as Pemberton. 
 
Last November, the Philippine National Police Crime Laboratory found that the DNA sample taken from Pemberton does not match the one found at the scene, the toilet inside a room at the Celzone Lodge in Olongapo City, where Laude was killed.
 
Despite this, Olongapo City Prosecutor Emilie Fe Delos Santos had expressed confidence that the result of the DNA examination would have no effect in the government's case against the 19-year-old American serviceman, saying they have other witnesses.
 
Pemberton was a participant in a recently concluded joint military exercise between Filipino and US forces in Subic and is covered by the Visiting Forces Agreement.
 
Under the VFA, US servicemen who find themselves in conflict with the law in the Philippines shall remain under the custody of the US authorities until the resolution of the case. —Joel Locsin and Amanda Fernandez/KG, GMA News
